Renewal by Andersen LLC sent plaintiff Deric Perish at least a dozen calls and text messages over the course of a single week asking him to purchase the company’s products and services, according to a complaint filed Sept. 10 in the U.S. District Court for the Southern District of Indiana.
Perish argues he should not be getting these messages because his phone has been registered on the do-not-call list since 2021. Under the federal Telephone Consumer Protection Act, residential telephone subscribers can register their number to be placed on a “do not call” list. That protects them indefinitely from telephone solicitations.
Despite sending written and verbal requests to stop contacting him, the calls have continued, according to the complaint.
Perish is suing the company for violating the federal act and the Indiana Deceptive Consumer Sales Act. He brings the claims of behalf of a class of more than 100 people whose telephone numbers are on the do-not-call list but have received two or more calls from the defendant over the past year.
Perish is seeking statutory damages.
Renewal by Andersen is based out of Minnesota. The company’s headquarters did not immediately respond to a request for comment from The Indiana Lawyer.
Attorneys for the plaintiff also did not immediately respond to a request for comment.
The case is Deric Perish v. Renewal By Andersen LLC, 2:26-cv-00401.
