Subscribe NowWabash National Corporation has filed a lawsuit in Tippecanoe Commercial Court against Wing Power Systems Inc., alleging the Texas-based company failed to pay for more than $365,000 in truck chassis equipment.
In the complaint filed June 5, Lafayette-based Wabash claims it built and delivered a series of custom truck body units per an agreement with Wing but received no payment for 11 of the units. Wabash alleges it completed the work as requested and repeatedly invoiced Wing for the products and services, with no response.
A man who answered the phone at Wing’s offices in Dallas and declined to give his name didn’t dispute the debt. He said Wing was financially devastated when it lost many orders of its own in the aftermath of COVID and that he believed the debt with Wabash National would be discharged through the bankruptcy filing of Wing’s parent company, NGV Global Group Inc.
Wabash National, which is the 20th largest public company in Indiana based on 2023 revenue of $2.5 billion, is seeking damages from Wing on multiple legal grounds, including breach of contract, unjust enrichment and conversion.
The company says Wing’s total unpaid balance stands at $546,307 as of June 5, including $365,581 for equipment orders, and $180,726 in accrued interest, with a daily interest rate of $216 continuing to accrue.
Between August 2022 and early 2025. Wabash says, Wing submitted multiple orders for truck body units that were manufactured and, in some cases, mounted on chassis provided by Wing.
According to the lawsuit, Wabash received partial payments from Wing’s secured creditors—Mitsubishi HC Capital America and Sage Financial—for some of the units, but those payments covered only a fraction of the total amount owed.
Wabash says Wing has not disputed the invoices and has retained possession of the unpaid equipment, despite requests for payment or return. The company argues Wing’s failure to pay constitutes conversion under Indiana law and seeks triple damages and attorney fees.
