Report: Holcomb got private flights from casino magnate

Appeal from the United States District Court for the Southern District of Indiana, Indianapolis Division. Judge Tanya Walton Pratt.
Criminal. Reverses the U.S. District Court for the Southern District of Indiana’s application of a four-level enhancement on Alandous Briggs’ guilty plea to a charge of being a felon in possession of a firearm after drugs and firearms were found at his home during a parole visit. Finds no factual findings were made connecting Briggs’ firearms to his conviction for cocaine possession. Vacates his sentence and remands for resentencing consistent with the opinion.

7th Circuit reverses unwarranted gun sentence enhancement

The fact that drugs and guns were in the same place at the same time wasn’t enough to prove a man should have received a sentence enhancement for his convictions, the 7th Circuit Court of Appeals ruled, finding no connection between his felony cocaine possession and firearms.

Justices: ‘Reliable assurance’ of accident defense upholds conviction in baby’s death

A man’s convictions of neglect of his infant daughter resulting in death was affirmed Wednesday by the Indiana Supreme Court when justices ruled it was not improper under Indiana Evidence Rule 404(b) to admit other-bad-acts evidence to show lack of accident, so long as a there was reliable assurance that an accident defense would be raised.

Clowers appointed to Posey County bench

Travis Clowers has been appointed to the Posey Superior Court, succeeding Judge Brent Almon who retired last month. Clowers will be sworn in as judge at a later date.

Civil tort. Affirms the Porter Superior Court’s dismissal of Rosemary Quillen’s proposed medical malpractice complaints. Finds Quillen is not entitled to relief and that the trial court did not commit error in finding dismissal was the appropriate sanction for her failure to comply with the medical review panel chair’s schedule for submission of evidence.

Lake County deputy faces bribery, perjury counts in auto salvage scheme

A Lake County sheriff deputy is facing bribery and perjury charges after a three-month investigation revealed he illegally accepted cash for completing salvage vehicle inspection forms in order to make “fast and easy money,” according to authorities.  

COA: Med-mal dismissal affirmed for counsel’s untimely filings

A woman who partially blamed her attorney’s personal problems for her failure to timely file pleadings in her proposed medical malpractice complaints could not convince the Indiana Court of Appeals that her case should not be dismissed. Among other things, the appellate panel simply found she failed to spend her time wisely.
