Criminal. Reverses Christopher M. Hubbert’s 18-year executed sentence for his conviction of Level 2 felony dealing in methamphetamine. Finds Hubbert’s sentence is inappropriate in light of the nature of the offense and his character. Remands to the Bartholomew Superior Court to impose a sentence of 18 years, with four years executed in the Indiana Department of Correction and the remaining years served on probation with substance abuse counseling and placement in community corrections.

COA slashes 18-year DOC sentence, orders treatment for drug offender

A man sentenced to 18 years after being convicted in a drug sting operation will only serve four of those years in prison, the Indiana Court of Appeals has ruled, reversing a sentencing order that did not allow for probation or substance abuse treatment.

Lawyer suspended 20 years ago gets conditional reinstatement

An Indianapolis lawyer who was suspended more than 20 years ago has been conditionally reinstated to the Indiana bar. The reinstated attorney is permitted to practice on a probationary period.

New online court hearing calendar in use by more than 30 counties

The Indiana Supreme Court has launched a new online tool providing information about daily dockets for courts in more than 30 Indiana counties. The tool follows court rules requiring courts to make daily calendars public and permitting courts to livestream proceedings due to COVID-19.

Justices clear Knox County prosecutor in discipline case

The elected prosecutor of Knox County in southwestern Indiana has been cleared of a charge of “offensive personality” in an attorney ethics case arising from his conduct in a police investigation of a former deputy prosecutor’s sexual relationship with a woman serving time on meth charges. It’s the second time in days that justices have cleared an elected prosecutor in a discipline case.

Criminal. Affirms Benjamen Chastain’s sentence to the maximum 23 years, all executed in the Department of Correction, for his conviction of Class B felony child molesting. Finds the Orange Circuit Court did not abuse its discretion in sentencing Chastain, and his sentence is not inappropriate in light of the nature of the offense and Chastain’s character.
