License of embattled Charlestown big-cat zoo revoked

Civil. Reverses the denial of disability benefits to Gail Martin, finding a second administrative law judge’s decision was not supported by substantial evidence. Orders the award of benefits for Martin, finding her disabled.

7th Circuit reverses denial of disability benefits, awards benefits in ‘rare step’

In taking what it called a rare step, the 7th Circuit Court of Appeals has ordered an award of disability benefits to a woman who was previously denied her request for them. The 7th Circuit concluded an administrative law judge’s decision denying her request was not supported by substantial evidence.

Reversal: Relief granted for ineffective assistance of counsel in rape case

A man sentenced to 145 years after he was convicted of sexually assaulting his fiancé has been granted post-conviction relief on appeal. The Indiana Court of Appeals concluded the man was entitled to relief based on his appellate counsel’s ineffectiveness.

COA reinstates case seeking child support from non-biological father

The Indiana Court of Appeals has reinstated a petition to establish child support from a man who is not the biological father of the child. The panel concluded that time had run out for the man, who signed a paternity affidavit without reading it and waited years before taking judicial action.

 

Barnes lawyer faces discipline over relationship with former client’s ex

A legal titan in the Indianapolis office of Barnes & Thornburg is facing attorney discipline charges over an alleged improper romantic relationship. The litigator and former federal prosecutor is accused in a disciplinary complaint of an improper relationship with the ex-wife of a former Fishers money-manager client who was convicted of securities fraud and is nearing the end of a 10-year prison sentence.
