Affirms the district court’s order granting summary judgment for Orchard School Foundation after James Napier filed an employment discrimination lawsuit against the school. Finds that no reasonable fact finder could find that Napier lost his job based on his sex. Also finds no reasonable fact finder could determine that Napier’s litigation, rather than the events that led to his termination, was the “but-for” cause of Orchard’s decision not to rehire him.
