Criminal. Affirms Michael Shepard’s conviction of Level 6 felony battery resulting in moderate injury. Finds Shepard’s 30-month sentence imposed in Howard Circuit Court is not inappropriate considering the nature of the offense and his character.

Civil plenary. Affirms the Hamilton Superior Court’s award of damages to The George Insurance Agency, Inc. Finds the trial court did not abuse its discretion by excluding certain evidence during the damages hearing, nor in calculating damages awarded to the insurance agency. Finds it is entitled to the award of appellate attorney fees and remands for the calculation of those fees.

Criminal. Affirms Toby George’s conviction of murder and Level 4 felony unlawful possession of a firearm by a serious violent felon. Finds George demonstrated no reversible error in the Marion Superior Court’s admission of evidence.

Affirms the Marion Superior Court’s decision upholding the Office of Medicaid Policy and Planning’s revision to Golden Gate National Senior Care, LLC d/b/a Golden Living’s submitted nursing facility financial reports. Finds the reviewing court’s decision affirming the final order of the Indiana Family and Social Services Administration is not contrary to law.

Lucas D. Melton v. State of Indiana (mem. dec.)

Criminal. Affirms Lucas Melton’s conviction in Vanderburgh Circuit Court of two counts of Class C felony child molesting. Finds sufficient evidence to support the convictions.
