William Hurst appeals the Marion Superior Court’s denial of his motion to suppress drug evidence obtained upon an execution of a warrant to search his home. He argues there was no probable cause to issue the warrant, and the trial court didn’t establish the reliability of the information or the credibility of the reporter before finding probable cause to issue the warrant. It was based on a photograph texted by Hurst’s girlfriend’s 11-year-old daughter, who lived with her mother and Hurst, to her father. The photo was of marijuana. The father then reported the alleged offense to police.
Judges Edward Najam, Melissa May, and Paul Mathias will hear William Hurst v. State of Indiana, No. 49A02-1004-CR-378 at 1 p.m.
