Supreme Court rejects Think Tank trade secret appeal

A divided Indiana Supreme Court declined to hear an appeal from a northwest Indiana software company that unsuccessfully sued former employees it claimed divulged trade secrets to a competitor.

Justices last week in a 3-2 decision declined to take the appeal in 12-year-old lawsuit Think Tank Networking Technology Group of Merrillville filed against former employees who went to work for a competitor, Chester Inc. Chief Justice Loretta Rush and Justice Brent Dickson voted to hear the appeal.

The decision lets stand an Indiana Court of Appeals ruling affirming a directed verdict in favor of defendants who were accused of violating noncompete contracts, breach of contract and misappropriation of trade secrets.

Justices in the week ending August 14 denied transfer in 28 cases and granted no petitions for transfer. Indiana Supreme Court transfer dispositions may be viewed here.
