In re: Lester L. Lee, The William R. Lee Irrevocable Trust and Donald Eugene Lee and Robert Earl Lee v. Lester L. Lee

17-1582
Appeal from the United States District Court for the Southern District of Indiana, New Albany Division. Judge Richard L. Young.
Civil. Affirms the bankruptcy court’s grant of summary judgment for the William R. Lee Irrevocable Trust in its piercing the corporate veil action based on Lester Lee’s post-merger conduct stripping company assets from Lees Inns of America, Inc. Finds there was no error in the court’s order holding Lester personally liable to the trust for the balance due on the judgment.

Monday opinions
Indiana Court of Appeals
Beverly K. Oswald v. Tarek Shehadeh and Falon Vela

29A02-1711-PL-2627
Civil plenary. Reverses the Hamilton Superior Court’s decision to dismiss a breach of contract suit that found Indiana lacked personal jurisdiction over the defendants over Tarek Shehadeh and Falon Vela. Finds both defendants had sufficient minimum contacts with Indiana for the court to exercise personal jurisdiction over them. Also finds their due process rights will not be violated by proceeding Indiana. Remands for further proceedings.

Andrea Brown v. State of Indiana (mem. dec.)
18A-CR-30
Criminal. Affirms the Allen Superior Court’s imposition of Andrea Brown’s previously suspended sentence following the revocation of her probation. Finds the trial court properly exercised its discretion.

Alia Sierra v. State of Indiana (mem. dec.)
12A02-1710-CR-2339
Criminal. Affirms the Clinton Circuit Court’s waiver of juvenile jurisdiction for Alia Sierra. Finds the juvenile court did not abuse its discretion in determining Sierra failed to rebut the presumption that jurisdiction should be waived to the adult court.
