Curtis D. Shank v. State of Indiana (mem. dec.)

Criminal. Affirms Curtis Shank’s conviction of Level 1 felony attempted murder and his sentence of 48 years executed. Finds the Elkhart Circuit Court properly handled Shank’s requests for a speedy trial such that his Criminal Rule 4(B) rights were not violated. Also finds Shank has failed to show that his sentence is inappropriate.

T.W. v. State of Indiana (mem. dec.)

Juvenile. Affirms T.W.’s adjudication as a delinquent child for what would be Class B misdemeanor battery if committed by an adult but reverses her commitment to the Department of Correction. Finds the state presented sufficient evidence to support the true finding of Class B misdemeanor battery. Also finds the Delaware Circuit Court abused its discretion when it committed T.W. to the DOC. Remands with instructions that the trial court find a placement for T.W. at either a residential or hospital setting appropriate for her within 30 days.

J.O. v. State of Indiana (mem. dec.)

Juvenile. Affirms J.O.’s placement in the Indiana Department of Correction after he was adjudicated a delinquent. Finds the Allen Superior Court did not abuse its discretion.
