Subscribe NowThe family of the late Marion County Sheriff’s Deputy John Durm Sr. has filed a wrongful death lawsuit against Eskenazi Health, alleging it contributed to the deputy’s death at the hands of an inmate returning from a medical appointment.
The lawsuit alleges hospital security personnel failed to properly unchain and rechain inmate Orlando Mitchell, allowing him to allegedly strangle Durm to death on July 10, 2023, in the Marion County Jail’s vehicle port as Mitchell was returned from the hospital.
Legal counsel for Eskenazi told The Indiana Lawyer that the health system does not comment on pending litigation.
Also named as a defendant in the lawsuit is Cintas Corporation, which supplies the Marion County Sheriff’s Office with various safety and first aid products. The lawsuit accuses it of failing to properly maintain an automated external defibrillator at the jail.
Representatives for Cintas did not immediately respond to The Lawyer’s request for comment.
The family is seeking compensation to cover medical and funeral costs and attorney fees.
