IN Southern District Court seeking public comment on local rule amendments

The U.S. District Court for the Southern District of Indiana is seeking public comment on proposed amendments to its local rules, including possible changes to pro hac vice admissions.

The court is accepting public comments until June 15 on proposed amendments to Local Rules 5-2, 5-3 and 83-6.

The proposed amendment to Local Rule 5-2, related to the filing of documents, would update and insert language adding video and audio recordings to the list of documents exempt from the electronic filing requirement of Federal Rule of Civil Procedure 5(d)(3)(A).

Also, a subsection (c) would be added to Rule 5-2 providing that video, audio and similar media files be presented in an MP4, WMV, MOV or AVI format.

In Local Rule 5-3, which currently deals with eligibility, registration and “passwords” for electronic filing as well as exemptions from electronic filing, the amendment would replace the term “passwords” with “login credentials.”

Additionally, amendments to subsections b(1) and (2) would provide that when there is a change in attorney information, the attorney within five business days must change their contact information in PACER and “file a Notice of Change of Attorney Information form in each of the attorney’s pending cases.”

Lastly, the proposed amendments to Local Rule 83-6, concerning pro hac vice admission, would add new language concerning the specific ways that attorneys can seek pro hac vice admission, either by an attorney seeking admission or by an attorney of record in the case on behalf of the attorney seeking admission.

Attorneys filing a motion under subsections (b)(1) or (2) would be instructed to pay the pro hac vice admission fee during the electronic filing process, per the proposed amendment.

The change would also create a new section (d) regarding the form of motion or certification for pro hac vice admission, which must be filed pursuant to subsection (b).
