Indiana Supreme Court denies 9 requests for transfer

The Indiana Supreme Court denied nine requests for transfer last week.

All of the justices concurred in the decision to deny all nine requests for transfer last week.

The high court also only has one oral argument for the month of March.

The justices will be hearing Cave Quarries, Inc. v. Warex LLC, 24S-CT-39, on March 14.

Cave Quarries hired Warex to conduct controlled blasts at Cave Quarries’ property, which resulted in the destruction of the asphalt plant 25 feet from the blast.

The Orange Circuit Court denied Cave Quarries’ motion for partial summary judgment and found strict liability did not apply because Cave Quarries had assumed the risk of the damages.

The Indiana Court of Appeals affirmed the trial court’s ruling in September 2023.

The high court granted transfer of the case and will be hearing arguments at 9 a.m. in the Supreme Court Courtroom in the Statehouse.
