Paul Poppe and Susan Poppe v. Angell Enterprises, Inc.

Civil tort. Affirms the grant of summary judgment to Angell Enterprises Inc. on Paul and Susan Poppe’s negligence complaint. Finds Angell had no duty to protect the Poppes from being struck by an intoxicated driver. Also finds the Sullivan Superior Court did not err when it entered summary judgment for Angell.

Jeremy J. Stewart v. State of Indiana (mem. dec.)

Criminal. Affirms the revocation of Jeremy J. Stewart’s probation and the imposition of his previously suspended 664-day sentence. Finds the Bartholomew Circuit Court did not abuse its discretion by ordering Stewart to serve the entirety of his previously suspended sentence.

Willie A. Owens v. State of Indiana (mem. dec.)

Criminal. Affirms Willie A. Owens’ convictions of felony murder, two counts of unlawful possession of a firearm by a serious violent felony as a Level 4 felony and one count of false informing as a Class A misdemeanor, and his aggregate 99-year sentence in the Department of Correction. Finds Owens was not entitled to severance of one of his firearms charges as a matter of right. Also finds the Madison Circuit Court did not commit fundamental error by refusing to give a limiting instruction to the jury in its review of State’s Exhibit 175, a letter written by Owens, or by admitting State’s Exhibit 175 into evidence, nor did it abuse its discretion by allowing the state to introduce social media video into evidence. Finally, finds the trial court did not abuse its discretion in sentencing Owens, and his sentence is not inappropriate.
