Indiana Court of Appeals
Elijah Reginald Davis v. State of Indiana
24A-CR-1904
Criminal. Affirms Elijah Davis’ conviction in Lake Superior Court for murder. Finds the state did not mischaracterize Potential Juror Number 93’s voir dire testimony when offering its race-neutral reason for striking her from the panel. Also finds that Davis has not met his burden to establish fundamental error. Attorneys for appellant: J. Michael Woods, Maryrachel Durso. Attorneys for appellee: Attorney General Todd Rokita, Supervising Deputy Attorney General Ian McLean.

Facundo Ramos-Osario v. State of Indiana
24A-CR-1761
Criminal. Reverses the Marion Superior Court’s conviction of Facundo Ramos-Osario for operating a vehicle with an A.C.E. of .08 or more, a Class C misdemeanor. Finds that the totality of the circumstances does not establish that there was a reasonable, particularized suspicion to stop Ramos-Osario’s truck. Also finds the trial court abused its discretion in admitting evidence of the stop and anything that flowed from it. Attorney for appellant: Alexander Budzenski. Attorneys for appellee: Attorney General Todd Rokita, Supervising Deputy Attorney General Ian McLean.
