Malcolm Wilson v. Angelita Castaneda

Prisoner. Appeal from the United States District Court for the Northern District of Indiana, South Bend Division. Judge Jon DeGuilio. Affirms the district court’s dismissal of Malcolm Wilson’s pro se complaint against Indiana Department of Correction Lt. Angelita Castaneda at the screening stage under 28 U.S.C. § 1915A and the court’s later denial of his motion for reconsideration. Finds that Wilson’s disciplinary hearing did not violate the due process requirements of the 14th Amendment. Also finds Castaneda’s restitution order was supported by Wilson’s statements, video evidence of the incident, and the conduct reports of the staff which stated the injured inmate had to be transferred to an outside hospital. Jose L. Lopez Sanchez v. State of Indiana

Criminal. Reverses the Elkhart Superior Court’s denial of Jose Sanchez’s request to compel the discovery of police reports related to his criminal prosecution on a operating while intoxicated charge. Finds the trial court incorrectly determined that the state may utilize the Access to Public Records Act to prevent a defense attorney from obtaining discovery of police reports in a pending criminal case. Also finds the trial court abused its discretion by denying Sanchez’s motion to compel disclosure of the police reports. Remands with instructions to grant the motion to compel.
