Post-conviction. Affirms the denial of Thomas Hunter’s petition for post-conviction relief following his guilty plea to felony murder. Finds Hunter failed to prove he was denied due process based on an alleged Brady violation or that he received ineffective assistance of trial counsel.

Michael Middaugh v. State of Indiana (mem. dec.)

Criminal. Reverses Michael Middaugh’s sentence to an aggregate of 50 years served for convictions of burglary as a Level 2 felony, criminal confinement as a Level 3 felony, attempted sexual battery as a Level 4 felony and his enhancement for being an habitual offender. Finds the Elkhart Superior Court erred when it sentenced Middaugh outside of the express terms of his plea agreement.

E.T. and T.T. v. Indiana Department of Child Services (mem. dec.)

Juvenile CHINS. Affirms the Monroe Circuit Court’s adjudication of E.T., the minor child of father E.T. and mother T.T., as a child in need of services. Finds the evidence was sufficient to support the trial court’s CHINS adjudication.
