Alfred Williams Comer, Jr. v. State of Indiana

Affirms Lake County Superior Court Magistrate Kathleen Sullivan’s denial of Alfred Comer Jr.’s motion that the trial court should have applied 1,376 days of credit to reduce his fixed term of 60 years imprisonment after his murder conviction. Finds the trial court did not abuse its discretion by finding Comer already received credit for presentence incarceration and good time credit and was not entitled to any reduction in his fixed term of imprisonment. Joseph Ogilvie v. State of Indiana

Criminal. Affirms Joseph Oglivie’s conviction in Fayette Superior Court of unlawful possession of a syringe, a Level 6 felony, and his being found to be an habitual offender. Finds the jury could have reasonably found from Ogilvie’s statements and his reaction to the injection that Ogilvie possessed the syringe with the intent to inject a controlled substance into his body. Kevin McLinden v. Tangoe U.S. Inc.

Civil plenary. Reverses Marion Superior Court Judge Kurt Eisgruber’s dismissal of Kevin McLinden’s lawsuit against his former employer, Tangoe U.S. Inc. Finds that McLinden has demonstrated harm sufficient to confer standing at the pleading stage in that his allegations of monetary damages constitute an injury. Remands for further proceedings.
