Civil plenary. Affirms the denial of IBYH LLC’s motion to correct error, which challenged a grant of summary judgment in favor of Masiongale Electrical-Mechanical Inc. Finds the Delaware Circuit Court did not improvidently grant summary judgment to Masiongale.

Jung Hee Kim v. Han Chong, Kyung Choi, Bo Kang Park (mem. dec.)

Civil plenary. Affirms the Monroe Circuit Court’s entry of summary judgment in favor of Han Chong on Jung Hee Kim’s claim that Chong was responsible for the theft of Kim’s funds, which Kim intended to use to purchase a restaurant. Finds the trial court’s application of the law of the case doctrine was erroneous, but Kim nonetheless failed to designate evidence that would establish a genuine issue of material fact concerning her theft claim.

Donta D. Creighton v. State of Indiana (mem. dec.)

Criminal. Affirms the Ohio Circuit Court’s order imposing 545 days of Donta Creighton previously suspended sentence as a sanction for his probation violation. Finds the trial court did not abuse its discretion.
