The following 7th Circuit Court of Appeals opinion was posted after IL deadline Wednesday:
Whole Woman’s Health Alliance, et al. v. Todd Rokita, Attorney General of Indiana, et al.
21-2480, 21-2573
Appeals from the United States District Court for the Southern District of Indiana, Indianapolis Division. Senior Judge Sarah Evans Barker.
Civil. Stays pending further order of the 7th Circuit Court of Appeals an injunction issued by the Indiana Southern District Court barring Indiana from enforcing Indiana Code §§ 16-34-2-1(a)(1), (2), 16-34-2-1.1(a)(1), (4), (b)(1) and 25-1-9.5-8(a)(4). Finds that existing precedents provide strong grounds for concluding that Indiana is likely to prevail on the contested issues, but leaves the merits for resolution after full briefing and argument. Judge Diane Wood dissents with separate opinion.

Thursday opinions
Indiana Court of Appeals
Ryan Gordon Tracy v. State of Indiana (mem. dec.)
20A-CR-2052
Criminal. Affirms Ryan Tracy’s conviction of three counts of child molesting as a Level 1 felony and one count of child molesting as a Level 4 felony, and his aggregate 40-year sentence. Finds a nurse’s training and education qualified her as an expert with regard to sexual assault examinations, and the Shelby Superior Court didn’t abuse its discretion in allowing her expert testimony. Also finds Tracy’s sentence is not inappropriate.

Shellie R. Peltier v. State of Indiana (mem. dec.)
21A-CR-607
Criminal. Affirms Shellie Peltier’s conviction for possession of methamphetamine as a Level 6 felony. Finds sufficient evidence exists to sustain Peltier’s conviction.
