Civil plenary. Dismisses Bradley Burgess’ appeal of the Clark Superior Court’s order denying his petition for judicial review and affirming the decision of the Board of Zoning Appeals for the town of Utica that denied Burgess a variance of use for his real estate. Finds that Burgess did not timely petition for judicial review of the BZA’s decision and that the trial court erred when it found and concluded that he had timely filed his petition.
