Affirms the denial of the motion to dismiss filed by the city of Bloomington, Mayor John Hamilton, Christopher Cockerham and Nicholas Kappas, which challenged the amended verified complaint for declaratory judgment and writ of quo warranto filed by William Ellis and Andrew Guenther in reference to a Planning Commission appointment. Finds the petitioners have stated sufficient facts to demonstrate that they have standing to bring their complaint for declaratory judgment and request for a writ of quo warranto. Also finds the Monroe Circuit Court did not err in denying the motion to dismiss.

Justices to hear arguments on order for informant to sit for face-to-face interview

An order requiring a confidential informant to sit for a face-to-face interview with defense counsel will be reviewed by the Indiana Supreme Court during oral arguments Thursday. Justices will also hear arguments on petition to transfer in a case where a defendant was erroneously released from prison then reincarcerated.

Gov. Eric Holcomb will now get the chance to follow through on his pledge to veto a bill that would give state lawmakers the power to call themselves into session during public emergencies. Wisconsin cities also seek legal fees over Trump suit Indy firm filed

The cities of Green Bay, Kenosha and Racine are asking a federal judge to make former President Donald Trump pay more than $42,000 in legal fees in a case filed by an Indianapolis law firm challenging Wisconsin’s presidential election results. The request is in addition to more than $145,000 in fees sought by the state’s governor.

Amid accusations, Lake, St. Joseph judicial nominating bill passes Senate

The Indiana Senate approved a bill reducing local attorney input into who serves on the judicial nominating commissions for Lake and St. Joseph counties Monday despite objections from Democratic senators, one of whom insinuated the changes were triggered by anonymous complaints from candidates who had lost out on judge appointments.

Civil plenary. Affirms the grant of summary judgment to Dr. Syed J. Khan, Dr. Chaitanya Chekkilla and Christopher J. Scruton on the claim brought by Dawn and Matthew Riddle under 42 U.S.C. § 1983 for allegedly treating the Riddles’ children without permission. Finds undisputed evidence from which the Tipton Circuit Court could have determined the Riddles were aware of Khan’s alleged violations, which fell outside the statute of limitations period, and Khan’s actions were not part of a continuing wrong that extended the statute of limitations period as to him. Also finds Scruton was not entitled to summary judgment on the statute of limitations period, but because there was no material evidence showing he joined or conspired with the Indiana Department of Child Services to deprive the Riddles of their constitutional rights and no dispute of material fact that he actually deprived them of a constitutionally protected right, he was entitled to summary judgment on those grounds. Finally, finds the Riddles have not presented or designated evidence to establish that Chekkilla was a state employee or that she conspired or joined with any state officials to deprive the Riddles of their constitutional rights of any kind.

Man convicted of killing IU student Behrman denied SCOTUS review

The man convicted in the murder of Indiana University student Jill Behrman more than 20 years ago will remain in prison after the United States Supreme Court denied cert in his habeas case. The justices denied John Myers’ petition for writ of certiorari Monday.

COA upholds judgment for teens’ doctors on parents’ constitutional claims

Tipton County parents who alleged their children were unconstitutionally treated by doctors while in a grandmother’s care failed to convince the Indiana Court of Appeals that summary judgment for the doctors was inappropriate.

High court nixes Alex Jones’ appeal in Newtown shooting case

The U.S. Supreme Court on Monday declined to hear an appeal by Infowars host and conspiracy theorist Alex Jones, who was fighting a Connecticut court sanction in a defamation lawsuit brought by relatives of some of the victims of the Sandy Hook Elementary School shooting.
