High court grants transfer to CHINS case

The Indiana Supreme Court granted transfer today to a case dealing with whether a child can be determined to be a child in need of services with respect to one parent, but not the other.

In the case In re: The Matter of N.E.; N.L. v. Marion County Department of Child Services and Child Advocates, Inc., No. 49A02-0806-JV-522, father N.L. appealed the conclusion that N.E. was a CHINS and that the evidence doesn't support a finding she is a CHINS with respect to him. For more information on this case, read "Fit or unfit?" from the April 29-May 12, 2009, issue of Indiana Lawyer.
