Civil plenary. Reverses the Marion Superior Court’s grant of summary judgment to Brock Medsker. Finds the trial court erred in granting summary judgment in favor of Medsker on Indiana REMS, LLC’s counterclaim for mutual mistake of fact. Finds genuine issues of material fact remain regarding REMS’ counterclaim for mutual mistake of fact. Remands for further proceedings.

Anna M. Bischoff v. State of Indiana (mem. dec.)

Criminal. Affirms Anna Bischoff’s 14-year sentence for conviction of Level 3 felony dealing in methamphetamine. Finds Bischoff’s sentence is not inappropriate in light of the nature of her offense and her character.

Andrew J. Stone v. State of Indiana (mem. dec.)
18A-CR-2611
Criminal. Affirms Andrew Stone’s convictions of Level 6 felony resisting law enforcement and Level 5 felony battery resulting in bodily injury to a public safety official. Finds Stone did not raise an affirmative defense at trial that the state failed to rebut his Castle Doctrine affirmative defense. Finds Stone’s sufficiency claim for his resisting law enforcement conviction fails.
