About 250 lawyers face suspension over unmet dues, education requirements

More than 150 Indiana lawyers and nearly 100 out-of-state attorneys face suspension from the practice of law for unpaid dues, violations of Interest on Lawyer Trust Account rules or failure to comply with continuing legal education requirements.

The Indiana Supreme Court issued the blanket pending suspensions in a Wednesday order.

“Although the suspension is effective as of the date of this order for purposes of the reinstatement procedures that must be followed and/or any reinstatement fees that must be paid for reinstatement, the Court directs that the proscription against the actual practice of law will go into effect at 12:01 a.m. Eastern Daylight Savings Time on Monday, July 27, 2020,” says the order signed by Chief Justice Loretta Rush. “The delay from the date of this order to the suspension date is for the sole purpose of allowing time for copies of this order to be sent, received, and acted upon by the suspended attorneys.”

Those named in the order may be reinstated by complying with the applicable reinstatement procedures and by paying any applicable penalties, the order says. The reinstatement fee for attorneys who failed to pay their annual registration fee is $200 in addition to the annual registration fee. Likewise, a $200 reinstatement fee is imposed on attorneys who fail to meet CLE requirements. Those petitioning for reinstatement over CLE violations also must satisfy the educational deficiency and complete additional courses.

Requirements for reinstatement for dues violations are found in Indiana Disciplinary Admission and Discipline Rule 2(h). The reinstatement procedure for failure to comply with CLE requirements can be found in Indiana Admission and Discipline Rule 29, section 10(b). These rules are available here. 

Attorneys who requested additional time to comply with CLE requirements whose requests were granted by the Indiana Office of Admissions and Continuing Education are not included in the list of those suspended in the order, In the Matter of Failure to Comply with Continuing Legal Education Requirements, Nonpayment of Attorney Registration Fees, and/or Failure to Submit IOLTA Certification, 20S-MS-446.
