Subscribe NowThe Fox Corporation and Mark Sanchez, the former NFL quarterback and current Fox Sports commentator who was stabbed during an altercation in Indianapolis over the weekend, have been sued by the truck driver whom Sanchez is criminally accused of attacking.
Perry Tole, 69, filed a civil lawsuit in the Marion Superior Court on Monday, requesting a jury trial for damages he says he suffered after a physical altercation with Sanchez outside the Westin Hotel late Friday night. The lawsuit accuses Sanchez of assault/battery and Fox of negligent hiring.
The complaint says Fox “failed to supervise Sanchez” and knew or should have known about his “unfitness as an employee, propensity for drinking and/or harmful conduct.”
Sanchez was in Indianapolis to cover Sunday’s NFL game between the Colts and the Las Vegas Raiders.
Neither Fox Sports nor Tole’s attorney Erik May immediately responded to requests for comment.
According to the lawsuit, Tole was approached by Sanchez after he had parked at a loading dock area to recycle the hotel’s cooking oil.
Sanchez, who the complaint states appeared intoxicated, had told Tole that he could not be at the location, saying he had spoken to the hotel manager.
During their interaction, Sanchez had entered Tole’s work truck without permission, blocking Tole and preventing him from contacting his manager, according to the lawsuit.
Sanchez allegedly shoved Tole, who then responded by using pepper spray. Sanchez continued toward him, leading to an intense physical altercation that left Tole suffering significant injuries to his head, jaw and neck, the lawsuit says.
Sanchez also suffered wounds after Tole, fearing for his life, took out a knife and stabbed him, according to court documents.
Indianapolis Metropolitan Police Department officers were dispatched at about 12:35 a.m., and upon arrival, they found Tole “bleeding profusely and severely injured.” According to court documents, Tole suffered “severe permanent disfigurement, loss of function” and other physical injuries.
Sanchez has been criminally charged with felony battery resulting in serious bodily injury, unlawful entry to a motor vehicle and public intoxication.
Fox Sports posted on social media Saturday that Sanchez was in stable condition.
