Applications open for upcoming COA vacancy left by Molter

The Indiana Judicial Nominating Commission is accepting applications for an upcoming vacancy on the Court of Appeals of Indiana following the appointment of Judge Derek R. Molter to the Indiana Supreme Court.

Judges and lawyers in the second district of the Court of Appeals may apply for the position. The deadline to apply is noon ET on Aug. 12.

Candidates must be an Indiana resident living in the second appellate district and have been a member of the Indiana bar for at least 10 years or served as an Indiana judge for five years.

Molter, who joined the Court of Appeals in October 2021, was tapped by Indiana Gov. Eric Holcomb last month to be Indiana’s 111th Supreme Court justice.

Applications, which must be submitted through the Indiana Courts Portal, must contain pertinent background information, writing samples, references and educational transcripts. Letters of recommendation will also be considered.

The seven-member commission will consider the applicants. Chaired by Indiana Chief Justice Loretta H. Rush, the commission includes three lawyers elected by their peers and three citizen members appointed by the governor.

The commission will hold public interviews of qualified candidates, deliberate in an executive session and hold a public vote to send the three most qualified names to the governor. Holcomb will then have 60 days to select Indiana’s next Court of Appeals judge.

Another vacancy will soon open up on the lower appellate court when Judge Edward W. Najam Jr. retires. Najam, who was appointed to the COA in 1992, will step down from the bench this summer.

Applicants to succeed Najam will be interviewed next week.
