After judge’s plea, JQC investigating shooting

Civil plenary. Affirms the Tippecanoe Superior Court’s denial of Granite Management LLC and Jaffa Varsity 1 LLC’s motion to correct error on a jury verdict in favor of Syed Husainy on his claim under Indiana Code § 32-31-8-5, but reverses the grant of the appellees’ motion to correct error on the jury verdict in Husainy’s favor on his breach of covenant claim. Finds the trial court abused its discretion in granting the motion to correct error on the breach claim but did not abuse its discretion in denying the motion to correct error on the statutory claim. Also finds the trial court abused its discretion in awarding Husainy only $2,000 in attorney’s fees. Finally, finds Husainy has waived his argument that the trial judge was biased against him and should have disqualified himself. Remands to reinstate the jury’s verdict on the breach claim, and to reconsider Husainy’s request for fees.

Southern District finds ‘immediate need’ to remove, amend death penalty rule

The Indiana Southern District Court determined there was an immediate need to delete Local Criminal Rule 6-1 ­– Petitions Under 28 U.S.C. Section 2254 or 2255 in Cases Involving a Sentence of Capital Punishment, according to a Monday notice. In response, the rule was replaced with the adoption of Local Criminal Rule 38-2 – Cases Challenging the Conviction and/or Sentence Where a Sentence of Death Has Been Imposed.  

Supreme Court accepting applications for state public defender

Indiana, Illinois AGs investigate after fetal remains found

Indiana’s attorney general said Monday he will work with his Illinois counterpart to investigate what he called the “grisly discovery” of more than 2,000 medically preserved fetal remains at the Illinois home of a late doctor who performed abortions in Indiana. Republican Attorney General Curtis Hill said he and Democratic Illinois Attorney General Kwame Raoul have “agreed to work together” as Hill’s office coordinates an investigation of the remains found at the home of Dr. Ulrich Klopfer, who died Sept. 3.

Porter County driver accused of letting students drive bus pleads guilty

A former northwestern Indiana school bus driver who authorities say allowed children as young as 11 years old to drive a bus has pleaded guilty in an agreement with prosecutors. Joandrea McAtee, of Portage, who was charged with a felony count of neglect of a dependent, entered the agreement Monday.

Justices: Amended statute retroactively applies in eminent domain action

COA affirms ruling for insurer in UIM recovery case
