SCOTUS rejects Indy lawyer’s Trump election lawsuit

An Indianapolis law firm’s suit seeking to overturn the results of the Wisconsin election on behalf of former President Donald Trump was rejected Monday by the United States Supreme Court, putting an end to the challenge.

Appeal from the United States District Court for the Northern District of Indiana, Hammond Division. Senior Judge Theresa L. Springmann.
Civil. Affirms the district court’s grant of summary judgment to the United States on the Federal Tort Claims Act action brought by Dominque Woodson on behalf of her son, P.W. Finds the plaintiffs’ claims were untimely, and they do not satisfy the second element of the savings provision of the Westfall Act. Also finds the plaintiffs’ claims do not qualify for equitable estoppel or equitable tolling. Judge David Hamilton dissents with separate opinion.

Lilly Endowment gives $250K boost to legal aid

Divided 7th Circuit upholds judgment against mom of injured child

A mother whose son was injured in a “traumatic” birth experience cannot proceed with her tort claims against the federal government because her claims were untimely, a divided panel of the 7th Circuit court of Appeals has ruled. A dissenting judge, however, warned of setting an “extraordinarily harsh” standard.

7th Circuit: State courts, not federal, should rule on counsel for kids in CHINS cases

The question of whether children in CHINS proceedings should be appointed counsel is best left for state court resolution, the 7th Circuit Court of Appeals has ruled, finding no “civil Gideon” principle requiring counsel in child welfare cases.

Plans curbing Indiana governor’s emergency power face doubts

Indiana lawmakers have advanced bills that would curb a governor’s authority to impose emergency restrictions such as mask rules and business closures, although Republican Gov. Eric Holcomb and a former state Supreme Court justice, among others, question whether those proposals written by members of Holcomb’s own party are allowed under the state Constitution.

Advocates ask U.S. Supreme Court to review Indiana absentee voting laws
